Agreement to Our Legal Terms

We are Busy Halal LLC ("Company," "we," "us," "our"), a company registered in Illinois, United States at Springfield, IL 62704.

We operate the mobile application Busy Halal (the "App"), as well as any other related products and services that refer or link to these legal terms (the "Legal Terms") (collectively, the "Services").

Busy Halal is a halal marriage app for serious Muslims aged 25 and older who are seeking a committed Islamic marriage. The app serves divorced parents, widows, widowers, and busy professionals who want a valid halal marriage but cannot commit to a shared household full-time. This app is for marriage intent only — not dating or casual relationships.

These Legal Terms constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you"), and Busy Halal LLC, concerning your access to and use of the Services. You agree that by accessing the Services, you have read, understood, and agreed to be bound by all of these Legal Terms. IF YOU DO NOT AGREE WITH ALL OF THESE LEGAL TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES AND YOU MUST DISCONTINUE USE IMMEDIATELY.

The Services are intended solely for users who are at least 25 years old. Persons under 25 are not permitted to register.

1. Our Services

The information provided when using the Services is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation or which would subject us to any registration requirement within such jurisdiction or country.

The Services are not tailored to comply with industry-specific regulations (HIPAA, FISMA, etc.). You may not use the Services in a way that would violate the Gramm-Leach-Bliley Act (GLBA).

2. Intellectual Property Rights

Our intellectual property

We are the owner or the licensee of all intellectual property rights in our Services, including all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics in the Services (collectively, the "Content"), as well as the trademarks, service marks, and logos contained therein (the "Marks").

Your use of our Services

Subject to your compliance with these Legal Terms, we grant you a non-exclusive, non-transferable, revocable license to access the Services and download or print a copy of any portion of the Content to which you have properly gained access, solely for your personal, non-commercial use.

Your submissions and contributions

Submissions: By directly sending us any question, comment, suggestion, idea, feedback, or other information about the Services ("Submissions"), you agree to assign to us all intellectual property rights in such Submission.

Contributions: The Services may invite you to chat, contribute to, or participate in blogs, message boards, online forums, and other functionality during which you may create, submit, post, display, transmit, publish, distribute, or broadcast content and materials to us or through the Services ("Contributions").

When you post Contributions, you grant us an unrestricted, unlimited, irrevocable, perpetual, non-exclusive, transferable, royalty-free, fully-paid, worldwide right and license to use, copy, reproduce, distribute, sell, resell, publish, broadcast, retitle, store, publicly perform, publicly display, reformat, translate, excerpt, and exploit your Contributions for any purpose.

3. User Representations

By using the Services, you represent and warrant that: (1) all registration information you submit will be true, accurate, current, and complete; (2) you will maintain the accuracy of such information; (3) you have the legal capacity and agree to comply with these Legal Terms; (4) you are not a minor; (5) you will not access the Services through automated or non-human means; (6) you will not use the Services for any illegal or unauthorized purpose; and (7) your use of the Services will not violate any applicable law or regulation.

4. User Registration

You may be required to register to use the Services. You agree to keep your password confidential and will be responsible for all use of your account and password. We reserve the right to remove, reclaim, or change a username you select if we determine it is inappropriate, obscene, or otherwise objectionable.

5. Purchases and Payment

We accept Visa, Mastercard, American Express, and Discover. You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Services. All payments shall be in US dollars.

6. Subscriptions

Billing and Renewal

Your subscription will continue and automatically renew unless canceled. The length of your billing cycle is monthly.

Free Trial

New members receive a 30-day free Gold trial. No payment method is required and the trial never converts to a paid subscription automatically. Paid subscriptions renew monthly until cancelled; cancelling keeps access until the end of the paid period.

Cancellation

You can cancel your subscription at any time by logging into your account. Your cancellation will take effect at the end of the current paid term.

Fee Changes

We may, from time to time, make changes to the subscription fee and will communicate any price changes to you in accordance with applicable law.

7. Refund Policy

Refunds are available within 7 days of a charge. After 7 days, all sales are final.

8. Prohibited Activities

You may not access or use the Services for any purpose other than that for which we make the Services available. As a user of the Services, you agree not to:

Systematically retrieve data or other content from the Services to create or compile a collection, compilation, database, or directory without written permission
Trick, defraud, or mislead us and other users
Circumvent, disable, or otherwise interfere with security-related features
Disparage, tarnish, or otherwise harm us and/or the Services
Use any information obtained from the Services to harass, abuse, or harm another person
Use the Services in a manner inconsistent with any applicable laws or regulations
Upload or transmit viruses, Trojan horses, or other harmful material
Engage in any automated use of the system
Attempt to impersonate another user or person
Interfere with, disrupt, or create an undue burden on the Services
Copy or adapt the Services' software
Misrepresent marital status — users may not claim to be single if legally or Islamically married
Use the app for casual dating or non-marriage purposes
Seek a second wife or additional spouse while already married
Share or distribute other users' private information
Lie about age — users must be 25 or older and may not misrepresent their age

Zawaj Mut'ah (temporary marriage), Misyar arrangements, polygamy, or any undisclosed additional-wife arrangements are strictly prohibited. This platform is for one sincere, lasting marriage only.

9. User Generated Contributions

The Services may invite you to chat, contribute to, or participate in blogs, message boards, online forums, and other functionality. When you create or make available any Contributions, you represent and warrant that they do not infringe any proprietary rights, are not false or misleading, are not obscene or objectionable, and do not violate any applicable law.

10. Contribution License

By posting your Contributions to any part of the Services, you automatically grant us an unrestricted, unlimited, irrevocable, perpetual, non-exclusive, transferable, royalty-free, fully-paid, worldwide right and license to host, use, copy, reproduce, disclose, sell, resell, publish, broadcast, retitle, archive, store, cache, publicly perform, publicly display, reformat, translate, transmit, excerpt, and distribute such Contributions.

11. Mobile Application License

If you access the Services via the App, we grant you a revocable, non-exclusive, non-transferable, limited right to install and use the App on wireless electronic devices owned or controlled by you, strictly in accordance with these Legal Terms.

12. Social Media

As part of the functionality of the Services, you may link your account with online accounts you have with third-party service providers. You represent and warrant that you are entitled to disclose your Third-Party Account login information to us.

13. Third-Party Websites and Content

The Services may contain links to other websites ("Third-Party Websites") as well as content belonging to or originating from third parties ("Third-Party Content"). Such Third-Party Websites and Third-Party Content are not investigated, monitored, or checked for accuracy by us.

14. Services Management

We reserve the right to: (1) monitor the Services for violations of these Legal Terms; (2) take appropriate legal action against anyone who violates the law or these Legal Terms; (3) refuse, restrict access to, limit the availability of, or disable any of your Contributions; (4) remove from the Services files and content that are excessive in size or burdensome to our systems; and (5) otherwise manage the Services to protect our rights and property.

15. Privacy Policy

We care about data privacy and security. By using the Services, you agree to be bound by our Privacy Policy, which is incorporated into these Legal Terms. The Services are hosted in the United States.

16. Copyright Infringements

We respect the intellectual property rights of others. If you believe that any material available on or through the Services infringes upon any copyright you own or control, please immediately notify us.

17. Term and Termination

These Legal Terms shall remain in full force and effect while you use the Services. WITHOUT LIMITING ANY OTHER PROVISION OF THESE LEGAL TERMS, WE RESERVE THE RIGHT TO DENY ACCESS TO AND USE OF THE SERVICES TO ANY PERSON FOR ANY REASON OR FOR NO REASON, INCLUDING FOR BREACH OF THESE LEGAL TERMS.

18. Modifications and Interruptions

We reserve the right to change, modify, or remove the contents of the Services at any time or for any reason at our sole discretion without notice.

19. Governing Law

These Legal Terms and your use of the Services are governed by and construed in accordance with the laws of the State of Illinois.

20. Dispute Resolution — Mandatory Arbitration and Class Action Waiver

Informal Negotiations

The Parties agree to first attempt to negotiate any Dispute informally for at least thirty (30) days before initiating arbitration.

Mandatory Arbitration and Class Action Waiver

By using our Services, you agree that any dispute, claim, or controversy arising out of or relating to these Terms or our Services shall be resolved through binding individual arbitration, not in court. YOU ARE WAIVING YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION LAWSUIT. Arbitration shall be conducted under the rules of the American Arbitration Association (AAA) in Illinois. Each party is responsible for their own legal fees. Nothing in this clause prevents either party from seeking emergency injunctive relief from a court where necessary to prevent irreparable harm.

21. Corrections

There may be information on the Services that contains typographical errors, inaccuracies, or omissions. We reserve the right to correct any errors and to change or update the information at any time, without prior notice.

22. Disclaimer

THE SERVICES ARE PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. YOU AGREE THAT YOUR USE OF THE SERVICES WILL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SERVICES AND YOUR USE THEREOF.

23. Limitations of Liability

IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES.

To the maximum extent permitted by applicable law, Busy Halal's total liability to you for any claim arising from or related to these Terms or our Services shall not exceed the total amount you paid to Busy Halal in the three (3) months immediately preceding the incident giving rise to the claim. This limitation applies to all claims of any kind, including but not limited to data breaches caused by outside factors, unauthorized access, or third-party attacks beyond our reasonable control. This limitation does not apply to claims arising from our gross negligence or willful misconduct.

24. Indemnification

You agree to defend, indemnify, and hold us harmless from and against any loss, damage, liability, claim, or demand made by any third party due to or arising out of: (1) your Contributions; (2) use of the Services; (3) breach of these Legal Terms; (4) any breach of your representations and warranties; (5) your violation of the rights of a third party; or (6) any overt harmful act toward any other user. This includes but is not limited to any claims arising from misrepresentation of marital status, identity, age, or marriage intentions on our platform.

25. User Data

We will maintain certain data that you transmit to the Services for the purpose of managing the performance of the Services. You are solely responsible for all data that you transmit or that relates to any activity you have undertaken using the Services.

26. Electronic Communications, Transactions, and Signatures

Visiting the Services, sending us emails, and completing online forms constitute electronic communications. You consent to receive electronic communications, and you agree that all agreements, notices, disclosures, and other communications we provide to you electronically satisfy any legal requirement that such communication be in writing.

27. SMS Text Messaging

Program Description

By opting into any Busy Halal text messaging program, you expressly consent to receive text messages (SMS) to your mobile number. Busy Halal sends SMS for account verification and account-related alerts only — one-time verification codes and safety texts you trigger yourself. We never send marketing or promotional SMS.

Message Frequency & Rates

Message frequency varies with your account activity (typically 1–2 messages per verification). Message and data rates may apply to any SMS messages sent or received. The rates are determined by your carrier and the specifics of your mobile plan.

Opting Out

If at any time you wish to stop receiving SMS messages from us, simply reply to the text with "STOP."

Privacy

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Phone numbers are used solely for the verification and safety features described above and are never sold.

28. California Users and Residents

If any complaint with us is not satisfactorily resolved, you can contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, California 95834 or by telephone at (800) 952-5210 or (916) 445-1254.

29. Miscellaneous

These Legal Terms and any policies or operating rules posted by us on the Services constitute the entire agreement and understanding between you and us. Our failure to exercise or enforce any right or provision of these Legal Terms shall not operate as a waiver of such right or provision.

30. Busy Halal Community Standards and Marriage Intent Policy

Busy Halal is exclusively designed for Muslims aged 25 and older who are seeking a committed halal marriage. By using this app users confirm that they are not currently married legally or Islamically anywhere in the world. Users must have sincere marriage intent — casual dating, temporary arrangements, and seeking additional spouses are strictly prohibited. All users must complete the Busy Halal Marriage Intent Pledge before accessing the platform. Religious information shared on this platform is treated as sensitive data and will never be sold, shared, or used for advertising purposes.

Busy Halal reserves the right to permanently ban any user found to be misrepresenting their marital status, age, identity, or marriage intentions. In the event of a ban resulting from misrepresentation, fraud, or violation of this policy, the banned user shall not be entitled to any compensation of any kind, whether monetary or otherwise. No refunds, credits, or payments of any kind will be issued to any user whose account is removed due to dishonesty, misrepresentation, or violation of our community standards, regardless of any remaining subscription time.

Refunds are available within 7 days of a charge for accounts in good standing. After 7 days all sales are final.

31. Verification Requirements

Members must verify their email and phone, pass a selfie check, and may complete government-ID verification (processed by Stripe Identity; Busy Halal never stores ID images). Unverified accounts are not visible to other members and cannot match or message.

32. Meeting Safety and Outcomes Disclaimer

Busy Halal does not conduct criminal background checks. Identity verification reduces, but does not eliminate, the risk of misrepresentation. You are solely responsible for your interactions with other members, online and offline. Busy Halal is not responsible for the conduct of any member or the outcome of any meeting, engagement, or marriage formed through the Services. Always meet in public places and inform someone you trust.

33. Suspension, Appeals, and Account Deletion

Accounts may be suspended for violations of these Terms. Suspended members have 72 hours to appeal. Account deletion permanently erases your profile, photos, and messages. Abuse reports and admin audit logs may be retained for safety and legal compliance.

34. Right to Remove Profiles

Busy Halal reserves the right to remove, suspend, or permanently delete any profile, account, or content at any time, for any reason, with or without notice, at our sole discretion. This includes but is not limited to profiles that violate our Terms, appear suspicious, or that we determine in our sole judgment are not in the best interest of our community. No reason is required to be given for removal decisions.

In the event of any removal, suspension, or deletion of an account, Busy Halal shall not be liable for any compensation of any kind, whether monetary or otherwise. No refunds, credits, or payments will be issued as a result of any account removal or suspension, regardless of the reason or circumstances, including but not limited to unused subscription time remaining at the time of removal.

35. Security Disclaimer

Busy Halal implements industry-standard security measures to protect your personal information, including encryption, identity verification, access controls, and regular security audits. However, no platform can guarantee absolute security. By using our Services you acknowledge and accept that despite our best efforts, unauthorized third parties may attempt to access our systems, and that such attacks are outside our control. We will notify you promptly if a security breach affects your personal data, in accordance with applicable law.

36. AI Tools Disclosure

Busy Halal was built with the assistance of artificial intelligence tools. AI was used in the development, design, and content generation of this platform. All AI-assisted features including voice onboarding transcription, blog article generation, and venue suggestions are clearly labeled within the app. AI tools assist our processes but all final decisions regarding accounts, verification, and content moderation are reviewed by human administrators.

37. AI-Generated Images

Some images on this platform are AI-generated and are used for illustrative purposes only. They do not represent real members or actual users of Busy Halal.

38. Google Analytics and Cookies

Busy Halal uses Google Analytics to understand how visitors use our platform. Google Analytics places cookies on your device to collect anonymous usage data including pages visited, time spent, and general location (city level only — never exact). This data helps us improve the platform and understand our community's growth.

You will be asked to accept or decline analytics cookies when you first visit our platform. If you decline, Google Analytics will not be loaded and no tracking cookies will be placed. You can change your preference at any time in your settings.

39. Social Media and Public Conduct

Users may not make false, defamatory, or deliberately misleading statements about Busy Halal, its team, or its members on any public platform or social media.

Users may not share confidential platform information, other members' private details, or screenshots of private conversations on social media or any public platform.

Users may not impersonate Busy Halal or claim to represent the platform on any social media account or public forum.
